Ostrander: Deleted computer files 'hearsay' - Times Union

MILTON – Former town supervisor Scott Ostrander said that deletion of town files and applications off of his computer before he left office is "hearsay."

“I’m telling you I don’t know anything about the computers,” Ostrander said after Wednesday's Town Board meeting. “It’s not true."

He also complained that any implication that he did such an act was "hurting his family."

Either way, it's not going to matter to current town Supervisor Benny Zlotnick, who on the first day on the job found that his computer was devoid of any recent files and applications. Zlotnick already announced he won't take legal action against Ostrander or his confidential secretary Shannon Doherty. And at the meeting, he went further, saying that he is satisfied with what the town’s independent IT specialist has recovered and won’t pursue trying to find out what else may be missing and why.

“I know there was some consternation about what happened,” Zlotnick said at the meeting. “I’m officially putting it to bed. We need to move on. I know some people will be disappointed by that, but some will not.”

Zlotnick said he came to that decision after meeting with the IT specialist, the town’s attorney Jim Craig and councilman John Frolish, an ally of Ostrander. Frolish, who often challenges Zlotnick, thanked him for making the decision. He also said the problem was a software upgrade issue.

“You just want everyone in the town to understand there is no officials records missing,” Frolish said. “We move on and do what’s in the best interested of the town.”

Zlotnick said that the old emails from Ostrander’s administration appear to be back. He also said some files have also been restored as were the deleted applications. He admits he is still unsure what is else missing and who deleted it. However, he did receive a text message from Doherty telling Ostrander there were "confidential files" on the computer.

“A forensic examination of the hard drive would be costly, about $5,000, and might not yield anything more,” Zlotnick said. “I don’t see any resolution that makes sense.”

Councilwoman Barbara Kerr is uncertain this is the best approach.

“I don’t totally agree,” she said. “There is a dark cloud hanging over our town and until we know what is missing from the hard drive, that’s not good. It’s not good for the town. It’s not good for Scott. By not addressing it, we all will remain under the black cloud. We can’t clear it up.”

While the meeting on Wednesday night was packed, only one resident questioned the board about the computers files. Mike Iacolucco asked if the town had a computer policy, if it was violated, if it was determined what was lost, what step it could take to determine what was lost and if the town is legally exposed because of the file loss.

Zlotnick said he would look into the town’s computer policy and create one if there isn't one in the employee handbook.

Doherty also attended the meeting. When asked by the Times Union after the meeting what happened with the computers, she would only say, “I’m not talking about any of it. What (John Frolish) said was the truth. That stuff was not gone.”

Ostrander said he attended the meeting to defend himself if anyone stood up to disparage him. But he also vowed never to seek office again.

"I’m not going to run in Milton," Ostrander said. "You don’t have to worry about me coming back and running in Milton.”
